Los Angeles: A California lawyer is suing Microsoft, claiming the Surface tablet he bought doesn't have all the storage space the company advertised.
Andrew Sokolowski says he bought a Surface with 32 gigabytes of storage last week. But he quickly ran out of space after loading it with music and Microsoft Word documents.
He discovered that half of the 32GB storage space was being used by the operating system and pre-installed apps. Sokolowski filed the suit Tuesday at the Superior Court in Los Angeles. He is seeking class action status. Microsoft says on its website that the 32GB Surface has 16GB of free space while the 64GB version has 45GB free. Microsoft didn't immediately respond to a request for comment.

With this logic in mind...

I should sue Seagate because the advertised 1TB External HDD does not show that it is 1TB in total size.

I should also sue Imation for the false advertisement of a 4GB USB.

I also have a Western Digital 2TB External HDD that shows as 1.87TB in Explorer, I guess I'll have to sue them aswell.

I don't blame the guy unlike your post MrXidus (I know sarcasm) the surface user found that half the memory was the Operating System which is a high amount considering how much you paid for it. The amount of storage in the drives is very close to what the product shows.

Which is a bigger gap.
surface: 32 GB having 16 GB for storage > 16 GB for the product
USB drive: 4 GB having 3.75 (rounded) for storage > .25 GB for the product

Logic still stands. I pay dollar for dollar when purchasing extended storage space. I'm extremely un-happy that the 4GB USB that I purchased was actually only 3.72GB, The additional 280MB of space was very much needed and I am very disappointed that I was lied to and did not have that space available. Lawsuit incoming, I want 2 million dollars for my suffering and stress that I dealt with because of not having that needed space when it was needed most and to pay for the damages of false advertising that has impacted not just my life but all my family members and friends that also fell victim to the false advertising.

Jokes aside. If he is a power user with multiple large applications, large music library and requires large storage space He should have researched more and waited to purchase a Surface with Windows 8 Pro that has 128GB of space. Or he can just store his music library on a large capacity USB/EXHDD and connect it to the Surface when needed, @ The things people complain about these days. I'll be surprised if this case actually sides for him, I hope it doesn't.

I don't fit into this scenario........... at all. I am the type of guy that will happily accept a 30GB, or 60GB solid state hard drive that is manufactured, R+D and assembled IN JAPAN over a 6 billion TB hard drive that is cheaper and made in China or any other country that cannot seem to export quality, only quantity.

What I know for sure is that I have had 4 PC's over the years. 3 of 4 of them had Seagate drives that were from China. 3 of 4 required service within a year due to the Seagate SCAT. The one computer that had a JAP drive in it worked flawlessly and was as crisp a virtual responder as I have ever had in a computer. That same tower with that same Jap hard drive was used by my brother for several flawless years as well. I did not see "Hitachi" on it. Regardless, "made in Japan" was enough for me.
Not saying China has all bad quality. I am simply saying that China's exports suck, esp. when it is required political correctness for Americans to buy their exports.

The real logic stands in the set standard of the difference we get for storage devices i.e. 6.87% for GB measure and 9.05% for the TB measure (reason you know better than me)

But a 50% difference ?????

Even if we ignore the difference standard, still there is something called "reasonable" and 16GB in place of 32GB is no way even near to reasonable.

Sarcasm Style :p

My ISP promises upto 2mbps speed, mind the word it say upto,
if it gives me 1kbps speed i should look for an ISP which promises 100mbs speed and gives me 2mbps :D

Jokes apart
Companies should learn to change there marketing techniques enough of fooling customers, everyone may not be able to afford higher storage devices when all they can give is 50% of the space ;)

P.S. I can understand your pain and sufferings for the shortage of 280 MB specially when only 224kb is all its free :p

Different thing, the up to is there. With storage, it clearly says that this one is supposed to have X GB space. So they basically don't deliver the promised thing. ISPs are just beep. Luckily mine isn't like that.

As far as I can see, it's not Advertised with 32 of 64GB of FREE SPACE, but rather total storage of the Surface.

The guys an... oh wait, how could I forget, the world revolves around money and greed.

Microsoft Sued For 32GB Surface Model Offering 16GB Free

Microsoft has been sued due to the 32GB variant of its Surface tablet delivering half that amount of storage space.

California lawyer Andrew Sokolowski filed the lawsuit relating to Microsoft's misleading advertisement regarding the storage space offered by Surface. He states that he bought the device in order to receive 32GB of storage before finding out he'd get just half of that.

Microsoft's Surface is indeed advertised as having 32GB of storage but delivers 16GB instead. However, the firm clearly states the situation regarding the tablet's storage space on its website, with the firm saying that the device comes pre-loaded with apps such as Word and Excel, as well as Windows recovery tools, while the bulk of storage space is taken by Windows RT. As for the 64GB model, users are left with 46GB of storage space.
