The ACLU contends long-term utility pole surveillance should require a warrant, "This technology allows police to secretly watch and record highly invasive details of our private lives, from when we leave and return home, to what we carry with us when we do, to who visits us, and when," said Nathan Freed Wessler, deputy director of the ACLU's Speech, Privacy, and Technology Project, in a statement. "Without a warrant requirement, nothing stops police from using these small, cheap cameras to watch anyone's — or everyone's — homes without limit."

The US Supreme Court has not yet decided whether it will consider the case.

?? where's the "expectation of privacy" once I leave the confines of my cozy home?? The article said the appeals court was split 3/3 but allowed the utility pole recordings into evidence overruling the lower court, and defendant pleaded guilty. Perhaps more to this story that is not stated? I have read articles about police beginning to use high tech drones to circle above their cities to record everything. We have become (are becoming) a surveillance society. Is this the best time for ACLU to bring this issue to US Supreme Court?

The ship sailed 15 years ago in regard to surveillance. You can't push the genie back into the bottle unless there is major privacy law reform and rulings handed down by the supreme court against the legal use of such surveillance tools and services.

And they have been using military style commercial drones for 10 years or more for surveillance in major cities. The drones can create a real time map of an urban city centre, it's very scary with direct feeds going back to HQ. They also extensively use hot spot technology (software) to direct police resources to high crime areas around the city which inevitably targets poor socio-economic neighbourhoods where crime exists. Together with the close monitoring of social media by state and federal authorities it creates a near total dragnet of society.

Dystopian future anyone?
