Kaspersky sues Microsoft over claims Windows 10 is 'incompatible' with third-party AV

KASPERSKY HAS become the latest company to file an antitrust complaint with the European Union, this time over Microsoft's Windows 10 operating system.

After first filing a complaint with Russian regulators from the Federal Antimonopoly Service (FAS), the security company has now turned its fire on European regulators, including the European Commission and German Federal Cartel Office.

The news comes less than a week after Google came under fire from EU chiefs who are planning to swipe up to $9bn from their kitty for uncompetitive behaviour. In a sensational claim, Kaspersky says that a customer in France was told by a Microsoft representative that "Windows 10 is incompatible with third-party antivirus. It's a shame that you've spent money on a Kaspersky Lab product, but you can't reinstall it without running the risk of the appearance of new bugs."

They also point to some promotional blurb for Windows 8 which says: "If you use Windows 8, you do not need to pay for antivirus software".

You do. You absolutely do.

Founder Eugene Kaspersky explains in a blog post: "We have users - hundreds of millions thereof all around the world. These folks trust us and depend on us to protect their data. They expect only the highest level of protection - that's why they chose us (and even if they chose different independent antivirus software, they're still affected by all this). And it's namely the right of these folks to choose exactly what they want that we're trying to protect.

"We see clearly - and are ready to prove - that Microsoft uses its dominant position in the computer operating system (OS) market to fiercely promote its own - inferior - security software (Windows Defender) at the expense of users' previously self-chosen security solution. Such promotion is conducted using questionable methods, and we want to bring these methods to the attention of the anti-competition authorities."

The issue surrounds Microsoft's use of its own Microsoft Defender antivirus system which provides basic protection for Windows 10 users. Kaspersky believes that the fact it cannot be turned off completely makes it a menace. In some cases, Kaspersky alleges, Windows will turn Kaspersky off in favour of Defender, or flag up warnings about whether Kaspersky is safe to install.

It's something that Microsoft has been terrible about in other areas such as the nagware to upgrade to Windows 10 and its stubborn defiance if you change web browsers from Edge. Kaspersky argues that Windows Defender is sold as being a competent alternative to paid-for antivirus software and that it is putting users in danger by denying them the advanced features of other packages.

The company recently had to deny that its products were being used by Russia to spy on US officials.

Totally agree, and will hand shake with Microsoft here. This is Kaspersky's and all other AV's intrusive and agressive coding which generate this errors and bugs, not Windows'.

While I'm not using any of the Big Dog security suites, I have seen evidence of what they have spoken in recent changes to MS windows 10. Norton also has been suffering from these small issues, several machines I have seen in the last couple weeks after the Creators update, just having Norton installed for the first time on a clean machine, are having issues being recognized by the new Windows Defender Security Center, not all machines are reacting the same though, some after the first Data Base Update and Patch of Norton, will after a few minutes recognize Norton and your good, others after ever reboot, have trouble still until the machine is fully loaded, up to this point, both Nortons Firewall and Windows Firewall and Nortons Av and Windows Defender will be running at the same time. Norton also claims this issue is from recent changes to Windows 10. Some users claimed that they thought it was because Windows 10 Creators update re-enables Fast start up if you have it disabled before the update and this was the issue, testing has told me otherwise.

Do not get me wrong though, I fully understand the business of 3rd party security, and the loss of revenue they could stand to lose as Windows becomes more independent, a look at Norton shows you a Fortune 500 company worth some cash. I also understand MS has it share of bugs as well as those companies.

Clearly, this is an open war between MS and Kaspersky also under the light of the latest spy news.
I can tell you that Emsisoft for example (since it is third party-AV) works fine, without any problems or errors on my Win10 system.
Now the question is: has Windows to adapt itself to third-party AVs or vice versa ? The paying user is in the middle for sure!

I would like to ask Mr. Kaspersky does all the component of KIS are fully compatible with 64 bit OS
if not then who should be sued Microsoft or Kaspersky
That is one of the main reasons i quit using KIS a long time back. Their lack of motivation to join the rest of the world on the 64 bit platform, even Norton who also was late to this, has finally added native 64 bit support.

It likely won't be too long before Microsoft goes 128bit computing too.

As harsh as it is been for most 32bit developments, (I was one of those where 32bit HIPS made my security awesome), 64bit is more and more getting the same attention as 32bit projects/softwares enjoy etc. and things are moving ahead at more rapid pace lately.

Also maybe it is M$ going more independent by "finally" making a serious effort in zipping things up with Win 10 but heaven knows that's long overdue and they probably are surely by now tired of being so limited when it comes to security and they taken the lions share of really bad press because of that (in spite of commercial/3rd party vendors filling that void)

As for Kaspersky vs Microsoft as to do with this, that's another (now new) story waiting to be played all the way out I guess.

Personally I am neither here nor there. I make no apologies for NOT leaning toward any vendor's AV products/services since HIPS and Virtualization swept in and showed what they could do and safely at that. :)

Oh, of course regular clean and timely backup images for insurance in case of some incense sticks pow wow influence that would want to slip through those.

The problem with some big name anti viruses is once you install them they kill the computer, AVG and Norton specially but many others as well thats why I use MSE or built in WD

Kaspersky couldn't do anything with specific 64-bit features because they just couldn't. Well, they could , really, but they would violate Windows' own 64-bit security (e.g. PatchGuard).

Kaspersky just documented what they couldn't do with 64-bit OS, unlike other AV companies that didn't. The products of these companies might have no full 64-bit protection also.

Let's put it this way, Kaspersky (and other products) wouldn't fully protect 64-bit OS because Windows, itself, is already protecting itself. So, there's no need for a 3rd party software to do the protection. :)

32-bit systems need more protection from Kaspersky because these systems don't have the protections present in 64-bit systems. So, when Kaspersky says that certain features don't work for 64-bit but work for 32-bit, it is because of certain OS protection features. :)

Guys guys....How about AV's file a anti-trust warrent and restraining order on these NSA/CIA for keeping exploits secret and not letting MS know about these critical holes instead of fighting with MS.
lol yes, every single AV company should get together with MS and go against the NSA/CIA :D

Bit fed up with Kaspersky and their complaints, they may as well grow up or go and buy a pack of dummies from their local gas station... The tables will turn one day and Kaspersky will wish they had have stepped back and let MS do their thing because at the end of the day without MS, Kaspersky would be nothing.

Microsoft could do something like make a new Extended Validation code cert but make it so themselves are the only publishers of these certificates, and then block any kernel-mode drivers which will perform specific actions without this cert. Then give it to other vendors and exclude the ones filing law suites and causing mischief, meaning vendors like Kaspersky lack features other vendors have at ease.

That'd be pretty funny.

I agree, something should be done about what CIA/NSA did, but it certainly won't be under anti-trust laws.
